City Attorney Martinez reported that the City Council did meet in Closed Session on the following <br />item: <br />CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION <br />ACTION: City Attorney Martinez reported that the presence of Councilmembers Bennett and <br />DeLaRosa is permissable to discuss the Rocks Club Dance Permit issue if they have reviewed the <br />video and written documents which were presented and discussed at the Council Meeting of June 1, <br />1999, regarding the revocation of the dance permit. City Attorney Martinez had been informed that <br />the Councilmembers had done so. <br />Councilmembers DeLaRosa/Bennett confirmed they had reviewed the video and written documents <br />of the July 1, 1999 Council Meeting related to the revocation of the Rocks Club dance permit. <br />City Attorney Martinez announced that by unanimous consensus Council directed Legal Counsel to <br />investigate and continue to discuss with the representatives of the Rocks Club to come to a resolution <br />of this issue. There are some weighty issues involved and the Council would hold RESOLUTION <br />NO. R-48-99 in abeyance pending informal negotiations with the Rocks Club representatives in order <br />to alleviate the Council's concerns without acting too quickly in this matter. Council wanted to make <br />sure to exhaust all available avenues before taking such as revoking a permit such as this. Council <br />has authorized the City Attorney's Office to work with the representatives of the Rocks Club to <br />possibly come to some resolution on the issues that were heard at the hearing on June 1, 1999. <br />MOTIONIVOTE: Motion/second by CM Cook/DeLaRosa to hold RESOLUTION NO. R-47-99 in <br />abeyance pending negotiations with Legal Counsel and representatives from the Rocks Club, motion <br />carried with Mayor Gaytan absent. <br />Attorney Roger Diamond for Rocks Club spoke in favor of the motion and indicated that his client <br />was open to work in a constructive manner with the City's representatives. <br />City Attorney Martinez clarified that the motion is to hold Resolution No. R-48-99 in abeyance <br />pending the negotiations with representatives from both sides and that this matter would return if the <br />negotiations do not pan out and asked if Attorney Diamond's client is amiable to discuss additional <br />conditions. Attorney Diamond responded that his client is open to discussing the entire framework <br />and hoped that the City in turn would be open to suggestions his client may make. <br />City Attorney Martinez inquired as to the petition filed for the following day Attorney Diamond. <br />Attorney Diamond indicated that it was a moot point as the resolution to revoke the dance permit was <br />not acted upon and therefore would notify the court to take the case off calendar subject to its being <br />reinstated should negotiations not work out. <br />City Attorney Martinez clarified for Attorney Diamond that the earliest that Council would discuss <br />the resolution of revocation of the dance permit would be July 6, 1999, the first Council Meeting in <br />July. <br />3 <br />
