City Attorney Carvalho cautioned that <br />remarks be limited to the moratorium ordinance. She indicated that a date had been set with Mr. <br />Vine to review items discussed in Closed Session. She emphasized that the only item before <br />Council was the adoption of the urgency ordinance and any action with respect to pending matter <br />with Mr. Vines was a separate issue and not agendized. Discussion continued. <br />City Attorney Carvalho opined that the law did not prohibit the City from extending the <br />moratorium but it did require the City to return within 45 days with a report. City Attorney <br />Carvalho announced the four findings recommended by Staff regarding the health, safety and <br />welfare aspects of this ordinance: Potential decreases in property values; potential property <br />damage in the area; aesthetics and ambient noise levels and also stated potential interference with <br />electronic equipment. <br />Motion made by Mayor Gaytan, seconded by CM Bennett and carried upon unanimous vote, to <br />approve Urgency Ordinance No. 0-09-99, enacted pursuant to California Government Code <br />Section 56868 temporarily prohibiting the establishment of power generating windmills and <br />similar structures that generate power from harnessing wind, pending study and adoption of <br />regulatory and stoning standards. <br />Circulation Element of General Plan (Aqua Mansa Road) <br />This was the time and place fixed to consider the negative declaration for minor amendment of <br />circulation element of General Plan to allow the City to study and consider the future possible <br />realignment and widening of Agua Mansa Road. <br />Mayor Gaytan declared the Public Hearing "open." <br />City Clerk Barrera informed that the Affidavit of Publication calling the Public Hearing was on <br />file in the City Clerk's Office and announced that she did not receive any protests or objections. <br />Assistant City Manager Parrish summarized his written report of April 27, 1999. <br />MOTION/VOTE: Motion/second by CM Sanders/Bennett to terminate the Public Hearing <br />carried upon unanimous vote. <br />Motion/second by CM Sanders/Bennett to approve and adopt RESOLUTION NO.
