He described the work that required a second change order <br />and stated that the notice of completion was for the waterline that was now installed. <br />MOTION/VOTE: Motion by Mayor Gaytan, seconded by CM Sanders, to authorize Change <br />Order No. 2 in the Amount of $40,843 and approve acceptance of the water line replacement <br />contract as 100% complete and to authorize the Utility Director to file the Notice of Completion. <br />Motion carried with CM DeLaRosa absent <br />SBIAA <br />CM Sanders presented the background for the City's participation in the San Bernardino <br />International Airport Authority. He recommended that the City continue, for purpose of <br />oversight and control, its participation in the agency. <br />MOTION/VOTE: Motion by CM Sanders to approve $10,000 Draw Request from the San <br />Bernardino International Airport Authority and incorporating the following provisions: <br />City Attorney Carvalho informed that on September 20th the airport authority circulated to all <br />members a proposed loan amendment. The following items were read and incorporated and made <br />a part of the primary motion: <br />1. The Loan documents shall refer to and apply to all prior and future loan payments. <br />2. The parties to the agreement, at this time, shall retain their status with respect to <br />receiving reimbursements, regardless of whether, in the future, they decided to stay in <br />the authority. <br />3. At present, there is no specific repayment date and a clear date shall be fixed. <br />4. If the Authority receives any money from leasing the hangar facilities, it is directed <br />that said money shall be used to offset the anticipated demand through the loan <br />agreement thus the Agency will not fold that new money into additional operating <br />expanses. <br />5. The whole arrangement shall be contingent upon the Airport Authority Board's <br />approval. <br />6. If a repayment of interest is not met when due, a penalty shall be applied and it shall <br />accrue if payments are not made. <br />At 7:48 P.
