Information, Census 2000 and Redistricting <br />City Attorney introduced Attorney Angie Castillo who presented a broad overview, via power <br />point, regarding the redistricting process, more particularly, the City's legal obligations and <br />options; history on districts; overview of census data; applicable federal and state laws; <br />redistricting criteria; deadline of November 1, 2001; use of impartial consultant to perform <br />redistricting project, hire legal redistricting experts or and/or use City Staff and BB&K Staff to <br />perform the redistricting project; return to at -large electoral system; and, possible concurrent <br />action regarding redistricting and referendum processes. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Community Sports Park, Big League Dreams <br />City Attorney Carvalho recommended approval of the proposed agreements, contingent upon the <br />acquisition of the site for the construction of the project and subject to any final negotiation points <br />requested by City Council. Assistant City Manager Holliman stated final approval would be <br />contingent on working out final details of land acquisitions. He recommended moving forward <br />with the consulting arrangement under the agreements; however, he warned of the financial risk <br />on the payment of the $300,000 management fees for construction to be paid up front. Discussion <br />followed on acceptance of conceptual approval, alcohol advertising, land acquisition, competition, <br />validation of business relationship, appointment of ad hoc committee, and, plan fees and <br />`- consultant fees. <br />Richard Odekirk, Managing Director of Big League Dreams, USA, pointed out that for the past <br />two years, City Staff had thoroughly examined the company's financial records of existing parks. <br />He asked City Council to make a commitment and a statement tonight to hire Big League Dreams <br />and it, in turn, would agree to not continue discussions or open conversations with any other cities <br />in the City's market place. He said that Big League Dreams was prepared to help the City solve <br />the land situation. He asked that the City pay its fee for the next four months. Ron Odekirk <br />spoke in support of the agreement. <br />City Attorney Carvalho advised that two changes could be made to the proposed agreement: <br />(1) The General Provisions, Termination of Agreement, Section 3.4.1.1 Ground for Termination <br />and (2) further negotiation of consultant fees due. After discussion, City Attorney Carvalho <br />offered to make changes to the termination section of the agreement, stating that between now and <br />the next 90 days the City reserved the right to terminate said agreement, for any reason <br />whatsoever; to add the proximity range of 10 miles; and, to include determined fees. <br />Scott Latalier, CEO of Big League Dreams, USA, agreed to exclusivity to 10 miles, that during <br />the term of consulting agreement, Big League Dreams would not have any discussions with any <br />other community during that period. In terms of fee arrangement, he agreed that instead of it <br />being front-end loaded that Big League Dreams would figure out the total amount of the fees, <br />divide them into an equal monthly basis and pay those over the course of time, of the required <br />minimum amount. <br />City Council Mins July 17, 2001 4 <br />
