After discussion, City Attorney Carvalho divided the figure of $150,000 by 15 to arrive at <br />$10,000 for the planning fees. The consulting fees would remain the same, at $16,000 but the <br />plan fees would be reduced to $10,000 per month, for a total of $26,000 per month, commencing <br />August 1, 2001, subject to termination by the City upon14 days notice. Ron Odekirk agreed to <br />the fees but reminded Counsel that the request was for a minimum of four months. Mayor <br />Bennett concurred. City Attorney stated that termination by the City would only occur after the <br />first four months, with 14 days notice. <br />MOTION/VOTE: Motion/second by CM Ramos/Chastain to approve the agreement with the <br />modifications stated by the City Attorney. Motion carried upon unanimous vote. <br />Discussion continued regarding the infrastructure, to include the 3-5 storm drain. Assistant City <br />Manager Holliman agreed. <br />PUBLIC HEARINGS: <br />Discontinuance of Public Park Land <br />This is the time and place fixed to proceed to discontinue and abandon for use a public park that <br />portion used as a parking lot in exchange for a larger area of privately owned land contiguous to <br />Veteran's Park. <br />Mayor declared the Public Hearing "Open." <br />City Clerk declared that the Affidavit of Publication was on file and reported that no protests or <br />objections were received. <br />Director Kenny stated that all legal requirements had been met and satisfied. <br />MOTION/VOTE: There being no request for public comment, motion/second by CM <br />Sanders/Chastain to terminate the Public Hearing carried upon unanimous vote. <br />There was brief discussion on substitute parking; Director Kenny responded. City Manager <br />Parrish agreed to look at CDBG, CIP or contingency funds for this project. <br />MOTION/VOTE: Motion/second by CM Chastain/Zamora to approve and adopt <br />RESOLUTION NO. R -54A-01, ordering the discontinuance and abandonment of a portion of <br />Veteran's Park as a public park, carried upon unanimous vote. <br />Basic Fee for Stormwater Management <br />This is the time and place fixed to consider adoption of a resolution amending the basic fee for <br />stormwater management and the stormwater management fee. <br />Mayor declared the Public Hearing "Open." <br />City Council Mins July 17, 2001 5 <br />
