Steel Road (APN 0164-31-29-0000) for the approval of an amendment to Conditional <br />Use Permit No. DCV -33-99 to authorize the acceptance, processing and transfer of <br />municipal mixed solid waste and consideration of a mitigated negative declaration and <br />mitigation monitoring and reporting program. <br />Mayor Bennett declared the Public Hearing "Open". <br />City Clerk Barrera said the Affidavit of Publication was on file in the City Clerk's Office <br />and stated that no protests or objections were received. <br />Community Development Director Zamora presented an overview of agenda report and <br />presented staff's recommendation to approve an Ordinance amending the Santa Ana <br />River Redevelopment Project Area Specific Plan and adopting a mitigated negative <br />declaration and mitigation monitoring and reporting program, and deny the appeal and <br />approve and adopt a resolution approving the 2003 amended CUP. <br />Public Comment: <br />The following citizens addressed the Council: <br />Roy Schenkenberger, American Self Storage, provided a handout followed with <br />comments and aerial photos, he spoke against the proposed project due to the smell <br />and recommended alternate sites, which is allowed as part of the process. <br />J.E. Dietrich, Dietrich International Trucking, expressed his concerns about the project <br />(1) odor (2) traffic; and wants to make sure the right thing is done and concern about the <br />statement of "minimal odor." <br />John Nolan, spoke against the project and favored a CEQUA evaluation and a negative <br />declaration and did not support staff's opinion not to have this evaluation. <br />Steve Anderson, stated that he supports the project, however, need to take into consider <br />the citizens, the result of possible negative problems this will bring, and the project <br />needs an EIR. He also provided 60 pages of court documents against Taormina. <br />Charles Jackson, suggested that the Council approve the item, however, the item should <br />have been presented to the Utilities Commission prior to Council consideration. <br />City Attorney Martinez asked if there were any additional comments or request to speak, <br />as the applicant has a right to respond to some of the issues presented: (1) odors (2) <br />traffic congestion (3) enforcement of conditions and mitigation (4) disagreement against <br />experts (5) contamination of wells; and suggested that if there are other issues that the <br />Council would like clarified now is the time to state them. CM Zamora requested a <br />response as it relates to CEQA. <br />City Attorney Martinez asked if the applicant, Taormima, needed additional time to <br />prepare their response.
