City Attorney Derleth announced that the City Council would meet in Closed Session to discuss <br />Item F below: <br />F. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION <br />Pursuant to Government Code Section 54956.9(b) <br />Number of Potential Cases: 1 <br />At 6:52 p.m., Mayor Bennett adjourned the meeting to Closed Session and at 7:10 p.m.; the <br />meeting reconvened with CM Zamora absent from the dais and CM Hernandez absent as <br />heretofore. <br />City Attorney Derleth reported that the Council did meet in Closed Session on Item F: <br />F. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATIONA <br />Number of Potential Cases: 1 <br />ACTION: NO REPORTABLE ACTION <br />PUBLIC HEARING: (cont'd) <br />Motion/second by CM Ramos/Chastain to close public hearing. Motion carried with CM Zamora <br />and CM Hernandez absent. <br />Motion/second by CM De La Rosa/Chastain to approve and adopt RESOLUTION NO. CUA <br />2003-08). Motion carried with CM Zamora and CM Hernandez absent <br />At 7:14 p.m. Mayor Bennett announced that due to family obligation she would be leaving and <br />turned over the balance of the agenda to Mayor Pro Tempore Chastain. At 7:15 CM Zamora <br />returned to her place at the dais. <br />ORDINANCES: <br />FIRST READING: <br />Transient Occupancy Tax <br />Waive Full Reading and Pass First Reading of an Ordinance of the City of Colton, California, <br />Amending Section 3.24.020 and Section 3.24.160 of Chapter 3.24 of Title 3 of the Colton <br />Municipal Code Regarding Transient Occupancy Tax, ORDINANCE NO 0-17-03. <br />City Attorney Derleth presented for consideration approval of staff's recommendation <br />Motion/second by CM Ramos/De La Rosa to waive full reading and pass first reading of <br />Ordinance No. 0-17-03. Motion carried with Mayor Bennett and CM Hernandez absent. <br />SECOND READINGS: <br />At 7:14 p.m. CM De La Rosa announced that he would recuse himself from discussion of Items <br />5 and 6 due to Conflict of Interest as he owns property within 500 yards of the project. <br />South Annexation #S-50 <br />Waive Full Reading And Pass Second Reading Of An Ordinance Approval Of The Pre -Zone <br />For South Annexation #S-50 (File Index Number Dap -000-030), Located In The S/W Portion Of <br />2003 JULY 15 CC/RDA/CUA <br />
