WHEREAS, in spite of the settlement of the above litigation, <br />the City remains in an emergency situation with regard to inade- <br />quate sewage treatment facilities, and such emergency conditions <br />will continue at least until the old treatment plant has been <br />renovated, tested, and placed into full operation; -and <br />WHEREAS, the Regional Water Quality Control Board is <br />monitoring Colton's sewage treatment situation closely and <br />has notified the City of impending enforcement actions and <br />penalties should satisfactory progress not be made toward <br />meeting waste discharge requirements, which requirements <br />cannot be met. without (among other things) renovation and <br />operation of the old treatment plant; and <br />WHEREAS, the City is making every effort to expedite <br />design, bid, contract award and renovation of the old treatment <br />plant, and has already contracted with consulting engineers <br />to prepare plans for and supervise same; and <br />WHEREAS, in spite of the lawsuit settlement and the <br />efforts set forth above, the City is not going to have. <br />sufficient sewage treatment facilities to meet anticipated <br />demand for the next year or more; and <br />WHEREAS, it is in the -best interests of the citizens and <br />property owners of the City for this Council to develop and <br />implement a plan for the fair allocation of the 330 interim <br />sewer connections as soon as possible, in order to provide <br />what partial relief the City can to citizens, property owners <br />and developers needing sewer connections during this interim <br />period; <br />-2- <br />
