BE IT ORDAINED by the City Council of the City of <br />Colton as follows: <br />1. Pursuant to the terms of the court order, the 330 <br />additional interim connections shall be allocated by the <br />priorities in Section 2. A request for a sewer connection <br />in a higher priority category shall be approved before <br />permits are granted in a lower category. If there are an <br />insufficient number of permits to satisfy all requests in a <br />particular category, the provisions of Section 4 shall <br />control the allocation process. <br />2. The priority categories are: <br />(a) FIRST: construction which will not require <br />additional sewer connections (remodeling or replacement of <br />existing dwellings, additions to existing structures, struc- <br />tures moved elsewhere within the service area, and similar <br />uses), and new connections necessary to alleviate serious <br />public health hazard as certified to the City by the County <br />of San Bernardino Health Department. Replacement connections <br />made pursuant to this subsection shall not be counted against <br />the 330 total, since no new net demand will be placed thereby <br />on the City's sewage treatment facilities. <br />(b) SECOND: commercial or industrial construction. <br />(c) THIRD: other types of construction for which <br />building permits had been issued before July 23, 1980, the <br />date'a temporary restraining order halting connections was <br />entered in the above litigation, and upon which substantial <br />-3- <br />
