Sections 66477, 65962, and 65858 of the California Government <br />Code; and <br />WHEREAS, pursuant to the provisions of Government Code <br />Section 65962, the fees enacted by Ordinance No. 0-11-88 were <br />only valid for a period of thirty (30) days and must now be <br />extended for an additional thirty (30) days; and <br />WHEREAS, a duly noticed public hearing was held on <br />May 3, 1988, on the extension of Orinance No. 0-11-88. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. The interim regulations and fees <br />contained in Ordinance No. 0-11-88 are hereby extended in <br />their entirety for an additional thirty (30) days and such <br />regulations and fees are hereby reenacted as though fully set <br />forth herein. <br />Section 2. Severability. It is the intention of <br />the City Council that the sections, subsections, clauses and <br />phrases of this Ordinance are severable, and if any section, <br />subsection, clause, phrase, or portion of this Ordinance is <br />for any reason held to be invalid or unconstitutional by a <br />court of competent jurisdiction, such decision shall not <br />affect the validity of the remainder of this Ordinance. <br />Section 3. Declaration of Urgency. Government Code <br />Sections 36937 and 65858 permit the adoption of ordinances on <br />an urgency basis for the immediate preservation of the public <br />health, safety, and welfare. In addition, Government Code <br />Section 65962(c) permits the interim authorization of a fee <br />or charge or increase in a fee or charge to protect the <br />public health, welfare and safety provided that the City <br />Council adopts findings describing the current immediate <br />threat to the public health, safety and welfare. The interim <br />authorization expires after thirty (30) days unless it is <br />extended after a noticed public hearing and it may be <br />extended twice for thirty (30) days each. The City Council <br />hereby finds that its current park and recreational fees have <br />been in effect since October, 1977. The City Council further <br />finds that the Consumer Price Index has risen approximately <br />ninety-four percent (94%) since that time. The City Council <br />further finds that the costs of providing park and <br />recreational facilities have risen dramatically in such time. <br />The average fee charged in surrounding cities is three to <br />four times that currently being charged by the City of <br />Colton. Moreover, the City Council finds that the City is <br />facing significant growth pressure with its population <br />increasing forty-one percent (41%) in five (5) years, and <br />-2- ORDINANCE <br />NO. 0-17-88 <br />
