ORDINANCE NO. 0-26-88 <br />AN ORDINANCE OF THE CITY OF COLTON ADDING <br />CHAPTER 12.36 TO THE COLTON MUNICIPAL <br />CODE RELATING TO THE LEVY OF STORM DRAIN <br />FEES FOR DRAINAGE BENEFIT AREA NO. 2 <br />WHEREAS, Government Code Section 66483 authorizes <br />the City of Colton (the "City") to impose fees by local <br />ordinance for the purpose of defraying the actual or esti- <br />mated costs of constructing planned drainage facilities for <br />the removal of surface and storm waters from local drainage <br />areas; and <br />WHEREAS, on December 1, 1987, the City Council of <br />the City of Colton ("this City Council") established City of <br />Colton Community Facilities District No. 87-1 ("CFD 87-111) <br />in part for the purpose of funding the construction of <br />required storm drain facilities and improvements to serve <br />new subdivision development occurring in and around the <br />boundaries of CFD 87-1; and <br />WHEREAS, the storm drain facilities and improve- <br />ments constructed within CFD 87-1 benefit properties outside <br />the boundaries of CFD 87-1; and <br />WHEREAS, the City has entered into an agreement <br />with the owners and developers of the property located <br />within CFD 87-1 to establish a master plan of drainage, <br />pursuant to Government Code Section 66483, to reimburse the <br />owners and developers for that portion of the expenses they <br />
