WHEREAS, it is the desire of this City Council to <br />levy fees on new subdivision development within Drainage <br />Benefit Area No. 2 to meet its obligation under the Agree- <br />ment to reimburse the owners and developers of CFD 87-1 for <br />certain costs they incurred in constructing storm drain <br />facilities and improvements within CFD 87-1; and <br />WHEREAS, this City Council has adopted Resolution <br />No. R-96-88 determining that the City's drainage plan for <br />Drainage Benefit Area No. 2 conforms to the Drainage General <br />Plan of the County of San Bernardino; and <br />WHEREAS, this City Council has found and determined <br />that the actual costs of the drainage facilities and <br />improvements constructed within CFD No. 87-1 are based upon <br />the facilities and improvements necessary to serve new <br />subdivision development within Drainage Benefit Area No. 2 <br />and that the fees to be levied are fairly apportioned on the <br />basis of benefits conferred on properties proposed for <br />subdivision development within Drainage Benefit Area No. 2; <br />and <br />WHEREAS, the fee to be levied on any property <br />proposed for subdivision development within Drainage Benefit <br />Area No. 2 does not exceed the pro rata share of the total <br />actual cost of the drainage facilities constructed within <br />CFD 87-1 which would be assessable on such property if such <br />costs were apportioned uniformly on a per acre basis; and <br />-3- <br />
