ORDINANCE NO. 0-27-88 <br />AN ORDINANCE OF THE CITY OF COLTON ADDING <br />CHAPTER 12.34 TO THE COLTON MUNICIPAL <br />CODE RELATING TO THE LEVY OF STORM DRAIN <br />FACILITIES FEES FOR DRAINAGE BENEFIT AREA <br />NO. 1 <br />WHEREAS, Government Code Section 66483 authorizes <br />the City of Colton (the "City") to impose fees by local <br />ordinance for the purpose of defraying the actual or <br />estimated cost of constructing planned drainage facilities <br />for the removal of surface and storm waters from local <br />drainage areas; and <br />WHEREAS, the City's Public Works Director, in <br />conjunction with the San Bernardino County Flood Control <br />District and the City of San Bernardino, has undertaken a <br />comprehensive study of the drainage areas and facilities <br />presently located within that area of the City lying within <br />the County of San Bernardino's Flood Control Study Zone 2; <br />and <br />WHEREAS, the results of that study demonstrate that <br />the existing drainage facilities are inadequate to effi- <br />ciently and effectively remove surface and storm waters <br />generated within County Flood Control Study Zone 2; and <br />WHEREAS, recognizing the immediate need to <br />construct new storm drain facilities to serve new develop- <br />ment within County Flood Control Study Zone 2, the San <br />Bernardino County Flood Control District, the City of San <br />
