Bernardino and the City of Colton have developed and agreed <br />to fund a storm drain improvement system known as CSDP <br />Project 3-5/Pepper Avenue Storm Drain; and <br />WHEREAS, that area of the City lying within County <br />Flood Control Study Zone 2 has been designated by the City's <br />Public Works Director as City of Colton Drainage Benefit <br />Area No. 1, the boundaries of which are shown on the map <br />attached hereto as Exhibit "A"; and <br />WHEREAS, the City's Public Works Director has <br />prepared a public report identifying the impacts of new <br />subdivision development within Drainage Benefit Area No. 1 <br />along with an analysis of the need for new storm drain <br />facilities and improvements required by such new develop- <br />ment, and which also sets forth the relationship between new <br />development, the needed facilities and the estimated costs <br />of those improvements; and <br />WHEREAS, it is the desire of this City Council to <br />establish and levy a storm drain facilities fee on new <br />subdivision development within Drainage Benefit Area No. 1 <br />for the purpose of constructing the planned drainage facili- <br />ties and improvements which will serve and benefit such <br />development; and <br />WHEREAS, the City Council has adopted Resolution <br />NoV97-88determining that the City's drainage plan for <br />Drainage Benefit Area No. 1 conforms to the drainage general <br />plan of the San Bernardino County Flood Control District; <br />and <br />-2- <br />
