ORDINANCE NO. 0-11-89 <br />AN URGENCY ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF COLTON AMENDING EXHIBIT "A" OF <br />ORDINANCE NO. 0-7-89 RELATING TO THE SENIOR <br />CITIZENS' SEWER SERVICE CHARGE <br />WHEREAS, on April 18, 1989 the City Council adopted <br />Ordinance No. 0-7-89 establishing a monthly sewer service charge <br />for senior citizens who satisfy certain criteria set forth in <br />Exhibit "A" of the Ordinance; and <br />WHEREAS, the City Council finds that the requirement set <br />forth in Section 2(c) of Exhibit "A" of the Ordinance, limiting <br />persons receiving sewer service at the senior citizens' rate to <br />wastewater flows of 150 gallons per day, will disqualify a sub- <br />stantial number of citizens of over 65 years of age from <br />qualifying for the senior citizens' sewer service rate; and <br />Whereas, the City Council finds that there is substan- <br />tial evidence indicating that senior citizens disqualified by <br />Section 2(c) from receiving wastewater service at the senior <br />citizens' sewer service rate should receive water at the senior <br />citizens' sewer service rate; and <br />WHEREAS, the City Council finds that substantial <br />economic hardship will result to the City's senior citizens by <br />strictly limiting the availability of the senior citizens' sewer <br />service rate; and <br />WHEREAS, the California Government Code Section 65937(b) <br />allows this legislative body to adopt, upon a four-fifths (4/5) <br />vote, urgency measures to protect the public peace, health, or <br />safety; and <br />
