In such cases, the base date for <br />purposes of determining permissible future rent increases shall <br />be the date of first rental or conveyance. <br />B. Decontrol Upon Vacancy. Whenever a vacancy occurs, the <br />initial rent charged to the subsequent tenant who moves a mobile <br />home onto }he space left vacant by the previous tenant or <br />charged to the subsequent owner of a mobile home left in place <br />shall be exempt from the space rent ceiling provisions of this <br />Ordinance as provided herein. Such rent shall be prospectively <br />controlled, however, using the rental amount charged the new <br />tenant at the date of transfer as the base rental amount subject <br />to increase after expiration of at least 12 months as provided <br />in Section 1.07A subject to the provisions of Paragraph C of <br />this Section. <br />C. Space Rent Agreement Exemption. Any rental agreement <br />in excess of twelve -months' duration which also meets all <br />criteria specified by Section 798.17 of the California Civil <br />Code, including, but not limited to, the tenant notification <br />requirement within the first paragraph of such rental agreement, <br />shall be exempt from the space rent ceiling provisions of this <br />Ordinance, but only during the term of such rental agreement or <br />one or more uninterrupted, continuous extensions thereof. If <br />such rental agreement is not extended and no new rental agree- <br />ment in excess of twelve -months' duration is entered into, then <br />the last rental rate charged for the space under such previous <br />,exempt rental agreement shall be the base rent for purposes of <br />this Ordinance. <br />CM <br />
