1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />ORDAINS: <br />Resolution No. 3609, Ordinance No. 1629, and Sections <br />13.16.025 through 13.16.060 of the Colton Municipal Code are amended to <br />read as follows: <br />13.16.025 Wastewater sewer service charges shall be as set <br />forth in Exhibit "A". <br />13.16.030 Wastewater capacity charges and wastewater <br />discharge permit fees shall be as set forth in Exhibit "B". <br />13.16.035 The wastewater capacity charges shall be solely <br />used to pay for the public wastewater facilities described herein. <br />13.16.040 On or about March of each year, the Public Works <br />Department shall determine the portion of wastewater capacity <br />charges which have been paid, but which remain unexpended or <br />uncommitted for five or more years after deposit with the City, <br />identify the purpose for which said charges are to be used, and <br />demonstrate there is a reasonable relationship between said charges <br />and said purpose. The estimated cost for needed public wastewater <br />facilities shall be updated annually. <br />13.16.045 Each year the Public Works Department shall <br />report its findings to the City Council at a noticed public hearing <br />and recommend any adjustments to the wastewater capacity charge or <br />other action as may be needed. <br />The provisions of this Ordinance supersede the charges and <br />fees set forth in Resolution No. 3609, Ordinance No. 1629, and Sections <br />
