ORDINANCE NO. 0- 7 -91 <br />AN URGENCY ORDINANCE OF THE CITY OF COLTON ESTABLISHING A 60 <br />DAY MORATORIUM ON FILING AND PROCESSING OF PETITIONS FOR <br />MOBILE HOME RENT INCREASES PURSUANT TO ORDINANCE NO. 0-19A-89. <br />WHEREAS, the City Council previously adopted a mobile home rent <br />control ordinance known as Ordinance 0-19A-89 that establishes <br />certain limitations on the right of mobile home park owners to <br />increase rent within mobile home parks; and <br />WHEREAS, pursuant to Ordinance 0-19A-89 the park owner for Rancho <br />Mediterrania Mobile Home Park recently petitioned for an individual <br />rent increase, submitted the matter to mediation, received a rent <br />increase of $175 per month per space, which increase was appealed <br />by the tenants; and <br />WHEREAS, the appeal hearing for the Rancho Mediterrania matter was <br />held on April 3, 1991 and the rent increase allowed by the mediator <br />was substantially reduced by the Rent Review Commission established <br />pursuant to the terms of Ordinance No. 0-19A-89; and <br />WHEREAS, during the course of the Rancho Mediterrania appeal <br />hearing it became clear that certain provisions of Ordinance No. 0- <br />19A-89 could be construed in a manner that does not effect the <br />purpose of Ordinance No. 0-19A-89, which is to protect mobile home <br />park tenants from unreasonable rent increases while assuring mobile <br />home park owners a fair return on their investment; and <br />WHEREAS, the City Council is informed and believes that other <br />mobile home park owners are in the process of preparing rent <br />increase petitions pursuant to the terms of Ordinance No. 0-19A-89; <br />and <br />WHEREAS, the City Council finds that significant revisions are <br />required for the proper implementation of the purposes of <br />Ordinance No. 0-19A-89; and <br />WHEREAS, the City Council has received proposed revisions to <br />Ordinance No. 0-19A-89 from the Mobile Home Rent Review Commission <br />that would address many of the procedural and substantive <br />difficulties that have recently come to light; and <br />WHEREAS, the City Council finds that unless a moratorium is imposed <br />on all petitions for rent increases and decreases that may be <br />brought forward under Ordinance No. 0-19A-89 confusion and <br />inconsistency will exist during the period of review and adoption <br />of required amendments to Ordinance No. 0-19A-89 as to the <br />application of the terms that ordinance and rent increases or <br />decreases might be approved that do not effect the purpose of that <br />ordinance; and <br />WHEREAS, the City Council finds that such confusion could lead to <br />inconsistent and unfair determinations regarding mobile home rent <br />
