increases or decreases that would undermine the purpose of <br />Ordinance No. 0-19A-89; and <br />WHEREAS, the City Council finds that in order to preserve the <br />public peace, health and safety it is necessary that City <br />ordinances be properly implemented in a fair and consistent manner <br />in order to assure respect for the law; and <br />WHEREAS, it is reasonable and just to require those wishing to seek <br />mobile home rent increases and decreases to allow the City <br />reasonable time before filing petitions pursuant to Ordinance No. <br />0-19A-89 to fully evaluate the recommended changes to that <br />ordinance in the interests of the protection of the public peace, <br />health and safety; and <br />WHEREAS, the City Council is authorized under Government Code <br />Section 36934 and 36937 to enact urgency ordinances for the <br />immediate preservation of the public peace, health or safety. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN <br />AS FOLLOWS; <br />SECTION 1.00: MORATORIUM ON FILING OF RENT INCREASE AND DECREASE <br />PETITIONS <br />No petition for rent increase or decrease shall be accepted for <br />processing under the terms of Ordinance No. 0-19A-89 for a period <br />of 60 days from the date hereof, or until adoption of an amendment <br />to Ordinance No. 0-19A-89 whichever occurs first. Notwithstanding <br />the foregoing prohibition, any petition for rent increase or <br />decrease submitted for filing during the life of this ordinance <br />shall be subject to retroactive implementation of any rent increase <br />or decrease determined to be allowable under Ordinance 0-19A-89 as <br />it may be amended by action of the City Council. <br />SECTION 1.01: SEVERABILITY <br />If any provisions of this ordinance or application thereof to any <br />person or circumstances is held t be invalid, this invalidity shall <br />not affect other applications of this Ordinance which can be given <br />effect without the invalid provision or application, and to this <br />end, the provisions of this Ordinance are declared to be severable. <br />This Ordinance shall be liberally construed to achieve the pruposes <br />of this Ordinance and to preserve its validity. <br />SECTION 1.02: URGENCY <br />This ordinance affects the public peace, health, and safety and <br />shall take effect immediately. The City Clerk shall certify to the <br />passage of this Ordinance and cause the same or a summary thereof <br />to be published within fifteen (15) days after adoption in a <br />newspaper of general circulation, printed and publichse in Colton, <br />
