The following criteria shall be used <br />to determine whether a waiver should be granted: <br />1. If the subject parcel(s) was created by a recorded parcel or final map, the <br />parcel map, tentative and final map shall be waived. <br />2. If the subject parcel was not created by a recorded parcel or final map, the <br />tentative map shall be waived and a parcel map is required. <br />16.27.060 Review by City Engineer. Upon review of the application as <br />provided for under this Section, the City Engineer shall recommend to the city <br />council the extent of waivers permitted. <br />1. Upon the grant of a full waiver as provided in section 16.27.050 (1), the <br />City Engineer shall prepare a Certificate of Compliance or Conditional Certificate <br />of Compliance, as appropriate, for recordation in the Office of the County Recorder <br />for the purpose of documenting the approval of the subdivision. The City Engineer <br />shall not record or release for recordation a Conditional Certificate of Compliance <br />prepared pursuant to this Section unless and until the owner or owners of the <br />property to be subdivided or the appropriate city agency, as the case may be, have <br />entered into an agreement with the city to provide for the satisfactory completion of <br />all conditions of Certificate of Compliance. <br />2. Upon the grant of a partial waiver provided in section 16.27.050, the City <br />Engineer shall not record or release for recordation the parcel map prepared <br />pursuant to this Section unless and until the owner or owners of the property to be <br />subdivided, or the appropriate city agency, as the case may be, have entered into an <br />agreement with the city to provide for the satisfactory completion of all conditions <br />of the parcel map. <br />J0161354 -3- <br />
