No application to establish or operate a gaming club <br />in the city shall be accepted or processed unless and until the electors of the city <br />affirmatively propose and approve an initiative measure in accord with California law <br />permitting legal gambling within the city . <br />9.12.030 City Council prohibited from proposing ballot measure No ballot measure <br />addressing the issue of legal gambling shall be proposed by the City Council. In the <br />event such a ballot measure is approved through the initiative process, any application <br />fee for a license to operate a gaming club in the city shall include such sum of money <br />as is necessary to reimburse the city for all costs and expenses incurred by the city with <br />respect to such ballot measure, as determined by the City Clerk. <br />9.12.040 Games prohibited. All games played with cards, dice, or other instrument, <br />thing, device or machine for money, chips, credit, or any other article exchangeable for <br />or redeemable in money, which games are not prohibited by any law of the State of <br />California are unlawful within the city. <br />9.12.050 Penalty for violations. Any person, or persons, violating any provisions of <br />this chapter is guilty of a misdemeanor and upon conviction thereof shall be punished by <br />a fine not exceeding three hundred dollars, or by imprisonment not exceeding three <br />months, or by both such fine and imprisonment." <br />2 <br />
