Sections 13.16.035, 13.16.040 and 13.16.045 are hereby amended in <br />their entirety to read as follows: <br />"13.16.035 Wastewater capacity charges—Use generally. <br />The wastewater revenues shall be solely used to pay for the public <br />secondary and tertiary wastewater facilities (operations and maintenance, <br />expansions and upgrades). <br />13.16.040 Wastewater capacity charges --Administration and use. <br />On or about March of each year, the Water and Wastewater Director <br />shall determine the portion of wastewater service charges and capacity charge <br />which have been paid, to determine if there is a reasonable relationship <br />between said charges and said purposes. The estimated cost for needed public <br />secondary and tertiary wastewater facilities' operations and maintenance, <br />expansions and upgrades shall be updated annually. <br />13.16.045 Wastewater capacity charges --Annual report by Wastewater <br />Department <br />Each year, the Water and Wastewater Director shall report the findings <br />to the City Council, and if deemed appropriate, recommend any adjustments or <br />other action as may be needed, to the wastewater service charges and capacity <br />charges." <br />SECTION 4: If any provisions of this Ordinance or application thereof to any <br />person or circumstances is held invalid, this invalidity shall not affect other applications of <br />this Ordinance which can be given effect without the invalid provision or applications, and to <br />this end, the provisions of this Ordinance are declared to be severable. This Ordinance shall <br />be liberally construed to achieve the purposes of this Ordinance and to preserve its validity. <br />3 <br />
