Effective July 1, 1996, rates and <br />charges for solid waste collection shall be no less than any fees paid by the city <br />to a refuse collection provider pursuant to any permit, franchise agreement or <br />contract entered into between the city and any such authorized refuse collection <br />provider. To the extent that any rates and charges set forth in any such permit, <br />franchise agreement or contract entered into by the city and an authorized refuse <br />collection provider cannot exceed specified rates and charges established by <br />Exhibits "A" and "B" of Ordinance 0-18-91 as adopted by the city council on <br />December 3, 1991 (the Rate Exhibits), those rates shall remain in effect and be <br />unchanged by this section and the rates established by the Rate Exhibits shall be <br />deemed incorporated herein by reference for the sole purpose of establishing such <br />maximum charges." <br />SECTION 10: If any provisions of this Ordinance or application thereof to any person <br />or circumstances is held invalid, this invalidity shall not affect other applications of this <br />Ordinance which can be given effect without the invalid provision or applications, and to this <br />end, the provisions of this Ordinance are declared to be severable. This Ordinance shall be <br />liberally construed to achieve the purposes of this Ordinance and to preserve its validity. <br />SECTION 11: This urgency ordinance shall be in full force and effect <br />immediately upon its passage by the City Council pursuant to the provisions of Government <br />Code Section 36934 and as provided by law. <br />6 <br />
