"Person." Any individual, corporation, partnership, <br />association or other group or combination of the same acting as <br />an entity. " <br />SECTION 2. Section 5.24.020 of the Colton Municipal Code is hereby amended <br />in its entirety to read as follows: <br />RVPU]3\CSE\41102 <br />"5.24.020 Business License--Required/fee. <br />A. Every person practicing, engaging in, or carrying on <br />the business of a massage technician shall obtain and maintain a <br />City business license and pay the applicable business license fee <br />therefor. In addition, every person who owns or operates a <br />massage parlor shall ensure that a City business license for the <br />massage parlor is obtained and maintained and that the applicable <br />business license fee is paid therefor. The fee for massage <br />technicians who do not maintain a permanent place of business in <br />the city is one hundred dollars ($100) per day. The fee for massage <br />technicians who do maintain a permanent place of business in the <br />city is one hundred dollars ($100) per year. The fee for massage <br />parlor owners or operators shall be one thousand two hundred and <br />fifty dollars ($1,250) for the first year; provided, however, that if <br />there are no civil or criminal complaints regarding the licensee's <br />operations made during the first year which lead to successful civil <br />or criminal enforcement, the sum of seven hundred fifty dollars <br />($750) of such fee shall be refunded to the licensee. Thereafter, the <br />license fee for massage parlors shall be five hundred dollars ($500) <br />per year. <br />B. The requirements of this section shall have no <br />application and no effect upon, and shall not be construed as <br />applying to, a person who owns or operates a licensed cosmetology <br />establishment wherein massages are performed, so long as each <br />and every provision of Section 5.24.190 is satisfied. <br />Notwithstanding the foregoing, every person practicing, engaging <br />in, or carrying on the business of a massage technician in a <br />licensed cosmetology establishment shall obtain and maintain a <br />City business license and pay the applicable business license fee <br />therefor pursuant to subsection (a) above." <br />3 <br />
