Section 5.24.030 of the Colton Municipal Code is hereby amended <br />in its entirety to read as follows: <br />"5.24.030 Massage Permit--Required/fee. <br />A. It is unlawful for any person to own or operate, in or <br />upon any premises within the city, a massage parlor in the absence <br />of a City business license and a permit issued pursuant to the <br />provisions hereinafter set forth. It is also unlawful for any person <br />to engage in, conduct or carry on, to attempt to engage in, conduct <br />or carry on, or to permit to be engaged in, conducted or carried on <br />the business of massage technician at a massage parlor or any <br />location removed from a massage parlor within the city, including <br />a cosmetology establishment, in the absence of a city business <br />license and a permit issued pursuant to the provisions hereinafter <br />set forth. <br />B. Notwithstanding anything to the contrary in <br />subsection (a), persons who own or operate licensed cosmetology <br />establishments and who wish to provide incidental massage <br />services pursuant to Section 5.24.190, need not obtain a permit <br />pursuant to this Section. <br />C. All applicants for a permit under this chapter shall be <br />subject to a waiting period not to exceed one hundred twenty (120) <br />days starting from the date an application for such permit is first <br />submitted. Each applicant shall furnish the chief of police <br />sufficient information, as may be requested by the chief, so that an <br />adequate investigation of the applicant's background may be made. <br />D. Each applicant shall pay a non-refundable processing <br />and investigative fee at the time they submit their application for a <br />permit under this Section. The processing and investigative fee for <br />massage technicians and massage parlor owners or operators shall <br />be twenty-five dollars ($25) each." <br />SECTION 4. Section 5.24.110 of the Colton Municipal Code is hereby amended <br />in its entirety to read as follows: <br />RVPUB\CSE\41102 <br />"5.24.110 Employee --Restrictions. <br />No person shall be employed, used, or permitted to practice <br />as a massage technician by the holder of a permit for a massage <br />parlor or by the owner or operator of a licensed cosmetology <br />establishment in which incidental massage services are performed <br />4 <br />
