1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 ORDINANCE NO. 0-07-99 AN ORDINANCE OF THE CITY OF COLTON, CALIFORNIA CONCERNING THE SALE OF FIREWORKS FOR THE MILLENNIUM CELEBRATION WHEREAS, California Health and Safety Code, Section 12599.5 provides that a one-time retail se may be issued by the State Fire Marshall to authorize the sale of safe and sane fireworks from a.m. on December 26, 1999, until midnight of January 1, 2000, provided that a city adopts an ance or resolution authorizing such sales during that period within its boundaries; and WHEREAS, California Health and Safety Code, Section 12599.5(c) provides that this section become inoperative as of January 2, 2000; and WHEREAS, the City Council desires to adopt an ordinance authorizing the sale of safe and sane orks from 9:00 a.m. on December 26, 1999, until midnight of January 1, 2000, while also setting forth on the sale of such fireworks in order to reduce the risk of fires and fire related injuries, provide the > service organizations with an additional fund raising opportunity and provide safe and sane orks for use by citizens during the millennium celebrations; and WHEREAS, the Cotton Municipal Code sets forth various requirements pertaining to the sale of and sane fireworks, as well as the construction, maintenance, and operation of temporary stands for retail sale of safe and sane fireworks with which organizations granted a permit must comply and it is the intent of this ordinance to repeal any of those existing requirements; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS 2111 Section 1. Notwithstanding Sections 6.32.010 and 6.32.130 of the Colton Municipal Code, and sane fireworks, as defined in Section 12529 of the California Health and Safety Code may be and discharged within the city during the period beginning at 9:00 a.m. on December 26, 1999 and ig at 12:00 midnight on January 1, 2000 pursuant to the provisions of Article 32 of Chapter 6 of the >n Municipal Code.
