1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />URGENCY ORDINANCE NO. 0-09-99 <br />AN INTERIM URGENCY ORDINANCE OF THE CITY OF COLTON <br />ENACTED PURSUANT TO CALIFORNIA GOVERNMENT CODE <br />SECTION 65858 TEMPORARILY PROHIBITING THE <br />ESTABLISHMENT OF POWER GENERATING WINDMILLS AND <br />SIMILAR STRUCTURES THAT GENERATE POWER FROM <br />HARNESSING WIND, PENDING STUDY AND ADOPTION OF <br />REGULATORY AND ZONING STANDARDS. <br />WHEREAS, the City of Colton ("City") has adopted a zoning code regulating the uses <br />of land within the City, as codified in Title 18 of the Colton Municipal Code ("Municipal <br />Code "); and <br />WHEREAS, the Municipal Code lacks specific regulatory and zoning standards to <br />assure that power generating windmills and similar structures that generate power from <br />harnessing wind do not adversely affect the health, welfare and safety of the public; and <br />WHEREAS, to protect the health, safety and welfare of the public, California <br />Government Code Section 65858 authorizes the City to adopt an interim urgency ordinance <br />temporarily prohibiting the establishment of power generating windmills and similar structures <br />that generate power from harnessing wind, which, if approved, may be in conflict with <br />contemplated land use policies and regulations which the City is studying or intends to study <br />within a reasonable period of time; and <br />WHEREAS, the issuance of permits for power generating windmills and similar <br />structures that generate power from harnessing wind, without having zoning and regulatory <br />standards in place, threatens the public, health, safety and welfare of the public for the <br />following reasons: <br />RVPUB\MXW508759 <br />I <br />
