1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />211 <br />231 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-15-99 <br />AN URGENCY ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF COLTON ESTABLISHING REGULATIONS <br />FOR PERMITTING RESIDENTIAL AND GROUP CARE <br />FACILITIES AND OTHER CONGREGATE LIVING <br />FACILITIES <br />WHEREAS, there has been a trend away from institutionalization and toward <br />integration in local communities of the handicapped, mentally ill, recovering drug addicts and <br />alcoholics, the chronically ill and those elderly persons who need special care or supervision to <br />meet their daily needs; and <br />WHEREAS, frequently such special needs groups reside in residential or group <br />care facilities and congregate living facilities instead of with their families; and <br />WHEREAS, certain residential or group care facilities and congregate living <br />facilities for special needs groups are subject to state licensing statutes which limit the zoning <br />and other regulatory requirements that can be imposed by cities and other local public entities; <br />and <br />WHEREAS, other residential or group care facilities and congregate living <br />facilities are operated by non-profit organizations, religious groups and clean -and -sober living <br />organizations providing services to other special needs residents that are not regulated under <br />state licensing statutes, but may be protected by federal and state legislation, including the <br />Federal Housing Act Amendments of 1988, the Americans with Disabilities Act and the <br />California Fair Employment and Housing Act; and <br />WHEREAS, many times the proposed siting of certain residential or group care <br />facilities and congregate living facilities may result in severe impacts to the neighborhoods in <br />which they are proposed to be located, including impacts related to traffic, parking, noise and the <br />RVPUB\MXM\522830 <br />
