1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />21 <br />22 <br />23 <br />24 <br />25 <br />impairment of the integrity of residential neighborhoods; and <br />WHEREAS, the City of Colton wishes to adopt an ordinance to provide <br />regulations for residential and group care facilities and congregate living facilities to provide a <br />reasonable balance between the interests of and benefits to special needs groups and the interests <br />cf and burdens on the City's residential areas; and <br />WHEREAS, 42 U.S.C. §3604(f)(9) provides that nothing in the Fair Housing Act <br />Amendments "requires that a dwelling be made available to an individual whose tenancy would <br />constitute a direct threat to the health and safety of other individuals or whose tenancy would <br />result in substantial physical damage to the property of others;" and <br />WHEREAS, the proposed conditional use permit requirements contained in this <br />serve legitimate municipal interests related to the health, safety and welfare of the <br />s residential areas and no other alternatives exist to fully evaluate whether a dwelling <br />to be made available to individuals or groups of individuals will constitute a direct <br />to the health and safety of other individuals or whether a dwelling proposed to be made <br />available to individuals or groups of individuals will result in substantial physical damage to the <br />of others; and <br />WHEREAS, California Government Code Sections 36934 and 36937 empower <br />cities to adopt, by four-fifths vote, an urgency ordinance which is necessary for the immediate <br />preservation of the public peace, health and safety; therefore, <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />SECTION 1. California Government Code Sections 36934 and 36937 empower <br />to adopt, by four-fifths vote, an urgency ordinance which is necessary for the immediate <br />2711preservation of the public peace, health and safety.
