The siting of certain residential or group care facilities and <br />congregate living facilities may result in severe impacts to the neighborhoods in which they are <br />to be located, including impacts related to traffic, parking, noise and the impairment of <br />integrity of residential neighborhoods. <br />2. The Colton Municipal Code does not currently contain regulations <br />the siting and permitting of licensed or unlicensed residential or group care facilities <br />congregate living facilities. <br />3. The City has recently received several zoning inquiries regarding <br />placement of licensed and unlicensed residential or group care facilities, including one <br />related to the placement of a proposed transitional learning center for young adults. <br />4. This proposed Urgency Ordinance is necessary for the immediate <br />of the public peace, health and safety to insure that the placement of residential or <br />care facilities in the City of Colton do not adversely affect the integrity of residential <br />and do not create impacts that would constitute a direct threat to the health or <br />of individuals or whose tenancy would result in substantial physical damage to property. <br />SECTION 2. Chapter 18.04 of the Colton Municipal Code is hereby amended by <br />the following definitions: <br />"18.04.139. Congregate residence. Congregate residence means any building <br />portion thereof which contains facilities for living, sleeping and sanitation, as required <br />suant to the Uniform Building Code, and may include facilities for eating and cooking, for <br />1 -transient occupancy primarily by persons eighteen years old and older, in which the <br />ponsibilities for rent, housekeeping, cooking and other household maintenance chores are <br />.red among the occupants. <br />3 <br />
