1' <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />20 <br />21 <br />22 <br />23 <br />24 <br />(2) Congregate residences with more than ten occupants may be <br />allowed in the R-2 (Duplex Residential) and R-3 (Multiple Family Residential) zones subject to <br />rhe approval of a conditional use permit issued pursuant to Section 18.58.060 and in accordance <br />with the findings specified in Section 18.48.100.F. All such residences must comply with the <br />following requirements: <br />(a) Applicable requirements of the Uniform Building, Housing <br />and Fire Codes; and <br />(b) Parking spaces must be maintained in accordance with the <br />requirements of Chapter 18.36; and <br />(c) No sign which calls attention to the fact that the property is <br />a congregate residence may be posted. <br />F. Findings. In keeping with the intent of this Section to provide reasonable <br />accommodations for the needs of persons with disabilities to obtain housing, while at the same <br />time fulfilling its obligation to protect the integrity and residential character of the City's <br />neighborhoods, the city council finds that the following findings must be made by the planning <br />commission and city council in determining whether to recommend approval or denial of a <br />conditional use permit request or determining whether to approve or deny a conditional use <br />permit request. <br />(1) Based upon individualized inquiry and evidence, that the proposed <br />tenancy will not constitute a direct threat to the health or safety of other individuals and will not <br />result in substantial physical damage to the property of others. <br />(2) The proposed use of property complies with all applicable zoning <br />development standards applicable to other properties in the same zone." <br />SECTION 4. The enactment of this Urgency Ordinance has been determined to <br />be Categorically Exempt pursuant to the California Environmental Quality Act (CEQA) and <br />Section 15301(b)(3) of the state CEQA Guidelines. Staff is directed to file a Notice of <br />with the County Clerk within three (3) days following adoption of this Urgency <br />Ordinance. <br />SECTION 5. This Urgency Ordinance shall take effect immediately upon its <br />adoption. <br />2811 6 <br />
