10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />WHEREAS, pursuant to Article 11, Section 7 of the California Constitution, the City is <br />mthorized to enact measures that protect the health, safety and welfare of its citizens; and <br />WHEREAS, pursuant to Government Code Section 66000 et seQ., the City is <br />Lo impose fees and other exactions to provide necessary public facilities required to mitigate the <br />impacts of new development projects; and <br />WHEREAS, the Planning Commission of the City of Colton has recommended the City <br />Council adopt the Study, with the exception of the provisions relating to park and traffic fees. <br />WHEREAS, the Planning Cou nnission requested that further studies be commissioned <br />for park and traffic fees with the intention of establishing new fees. <br />WHEREAS, City staff has performed additional studies related to park and traffic fees. <br />WHEREAS, the City has: 1) Provided published notice and made available to the public, <br />at least ten days prior to its public hearing, data indicating the estimated cost required to provide <br />the public facilities for which these development fees are levied and the revenue sources <br />anticipated to provide those facilities; 2) mailed notice at least fourteen days prior to this meeting <br />all interested parties who have requested notice of new or increased development fees; and 3) h< <br />a duly noticed public hearing at which oral and written testimony was received regarding the <br />proposed fees; and <br />WHEREAS, City Staff has determined that acceptance of the Study, the Mohle-Grover <br />Study and imposition of the development impact fees (the "Project") is subject to the <br />of the California Environmental Quality Act ("CEQA'l and has prepared an initial study for the <br />Project; and <br />WHEREAS, on the basis of the initial study which indicated the Project would have no <br />significant impacts, staff determined that a negative declaration should be prepared for the Project <br />and <br />
