1 URGENCY ORDINANCE NO. 0-11-00 2 — 3 AN URGENCY ORDINANCE OF THE CITY OF COLTON, CALIFORNIA AUTHORIZING AN AMENDMENT TO THE 4 CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF COLTON AND THE BOARD OF ADMINISTRATION OF 5 THE CALIFORNIA PUBLIC EMPLOIYEES' RETIREMENT 6 SYSTEM 7 WHEREAS, the City Council desires to provide Retirement Benefits to Police 8 Department employees providing police protection to the City of Colton which the Council 9 finds will serve the immediate protection of life and property in the City; and 10 11 WHEREAS, Government Code Section 36937 authorizes the City Council to 12 adopt by a four-fifths vote, an urgency ordinance, which is necessary for the immediate 13 preservation of the public peace, health or safety. 14 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON 15 DOES FIND AS FOLLOWS: 16 Section 1: That an amendment to the contract between the City Council of the City of 17 Colton and the Board of Administration, California Public Employees' Retirement System is 18 hereby authorized, a copy of said amendment being attached hereto, marked Exhibit "A" and by such reference made a part hereof as though herein set out in full. 19 Section 2: The Mayor Pro Tempore of the City Council is hereby authorized, 2 ° empowered, and directed to execute said amendment for and on behalf of said Agency. 21 Section 3: The City Council hereby finds: That the passage of this Ordinance providing 22 California Public Employees' Retirement System Contract Amendment is necessary in order to preserve the public peace, health and safety. The City Council declares that the facts 2 3 constituting the urgency and the need to provide Contract Amendment include, without 24 limitation: 25 1. In accordance with City of Colton requirements and upon the advice of the City Attorney, the first reading of Ordinance 0-10-00 was approved by City 2 6 Council on September 19, 2000 with adoption at the next meeting of the City 27 Council on October 3, 2000. 2. City Council approved and adopted Resolution of Intention, R-74-00 on 28 September 19, 2000.
