1 <br />URGENCY ORDINANCE NO. 0-11-00 <br />2 — <br />3 AN URGENCY ORDINANCE OF THE CITY OF COLTON, <br />CALIFORNIA AUTHORIZING AN AMENDMENT TO THE <br />4 CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY <br />OF COLTON AND THE BOARD OF ADMINISTRATION OF <br />5 THE CALIFORNIA PUBLIC EMPLOIYEES' RETIREMENT <br />6 SYSTEM <br />7 WHEREAS, the City Council desires to provide Retirement Benefits to Police <br />8 Department employees providing police protection to the City of Colton which the Council <br />9 <br />finds will serve the immediate protection of life and property in the City; and <br />10 <br />11 WHEREAS, Government Code Section 36937 authorizes the City Council to <br />12 adopt by a four-fifths vote, an urgency ordinance, which is necessary for the immediate <br />13 preservation of the public peace, health or safety. <br />14 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />15 <br />DOES FIND AS FOLLOWS: <br />16 <br />Section 1: That an amendment to the contract between the City Council of the City of <br />17 Colton and the Board of Administration, California Public Employees' Retirement System is <br />18 hereby authorized, a copy of said amendment being attached hereto, marked Exhibit "A" and <br />by such reference made a part hereof as though herein set out in full. <br />19 <br />Section 2: The Mayor Pro Tempore of the City Council is hereby authorized, <br />2 ° empowered, and directed to execute said amendment for and on behalf of said Agency. <br />21 <br />Section 3: The City Council hereby finds: That the passage of this Ordinance providing <br />22 California Public Employees' Retirement System Contract Amendment is necessary in order <br />to preserve the public peace, health and safety. The City Council declares that the facts <br />2 3 constituting the urgency and the need to provide Contract Amendment include, without <br />24 limitation: <br />25 1. In accordance with City of Colton requirements and upon the advice of the <br />City Attorney, the first reading of Ordinance 0-10-00 was approved by City <br />2 6 Council on September 19, 2000 with adoption at the next meeting of the City <br />27 Council on October 3, 2000. <br />2. City Council approved and adopted Resolution of Intention, R-74-00 on <br />28 September 19, 2000. <br />
