The adoption of Ordinance 0-10-00 was approved and adopted on October 3, <br />2000, authorizing the Amendment to the Public Employees' Retirement <br />System Contract for Police Safety with an adoption date of October 3, 2000 <br />and effective date of November 2, 2000. <br />4. The effective date of the Ordinance met City of Colton requirements, however, <br />the date of the adoption needed to be on or after October 9, 2000, in order to <br />meet Ca1PERS contract amendment timing requirements. The adoption date <br />of October 3, 2000 was six days short of this requirement. <br />5. In order to comply with the 20 day requirement between the adoption of <br />Resolution of Intention and adoption of Ordinance, Ordinance 0-10-00 is <br />being repealed and resubmitted as an Urgency Ordinance and adopted on <br />October 17, 2000. In accordance with both City of Colton and CalPERS <br />adoption requirements, the adoption date will be immediate with an effective <br />date of Saturday, October 28, 2000 which is the first day of the payroll period <br />after the adoption date of October 17, 2000. <br />6. That the passage of this Urgency Ordinance in order to preserve the public <br />peace, health and safety. <br />Section 4: Upon the effective date of this Urgency Ordinance, Ordinance No. 0-10-00 <br />shall be deemed repealed. <br />Section 5: If any provision of clause of this Urgency Ordinance or any <br />application of it to any person, firm, organization, partnership or corporation is held invalid, <br />such invalidity shall not affect other provisions of this Urgency Ordinance which can be given <br />effect without the invalid provision or application, and to this end, the provisions of this <br />Urgency Ordinance are declared to be severable. <br />Section 6: This Urgency Ordinance shall take effect immediately upon its adoption. <br />Section 7: This Urgency Ordinance was adopted by the necessary four-fifths vote of the <br />members of the City Council pursuant to Government Code Sections 36934 and 36937. Prior <br />to the expiration of 15 days from the passage thereof, the Ordinance, or a summary of the <br />Ordinance, shall be published at least once in the SAN BERNARDINO SUN a newspaper of <br />general circulation in the City of Colton and hence forth and thereafter the same shall be in full <br />force and effect. <br />APPROVED AND ADOPTED thisl7th day of October, 2000. <br />1 <br />i 2-4/ <br />DEIRDRE H.
