1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 0-03-01 AN INTERIM URGENCY ORDINANCE OF THE CITY OF COLTON, CALIFORNIA, PROHIBITING THE ESTABLISHMENT OF RECREATIONAL VEHICLE DEALERSHIPS WITHIN THE CITY OF COLTON FOR A PERIOD OF 45 DAYS, PENDING THE COMPLETION OF A STUDY OF THE AFFECTS OF THE DEVELOPMENT OF ADDITIONAL RECREATIONAL DEALERSHIPS WITHIN THE CITY OF COLTON AND THE ADOPTION OF ANY AND ALL AMENDMENTS TO THE CITY'S LAND USE REGULATIONS THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. This interim urgency ordinance is adopted pursuant to Section 65858 of the California Government Code. SECTION 2. The City of Colton shall not issue or approve any building permit, conditional use permit, variance, precise plan of design or other land use entitlement for any recreational vehicle dealership on any property within the City of Colton during the time that this interim ordinance is in effect. For purposes of this ordinance, the term "recreational vehicle" shall be deemed to mean any large motorized vehicle and/or trailer, usually with facilities for sleeping and eating, used primarily for recreational activities such as camping. SECTION 3. The City Council hereby finds, determines and declares that this interim urgency ordinance adopted pursuant to California Government Code Section 65858 is necessary because: A. The establishment of additional Recreational Vehicle (RV) dealerships within the City presents an immediate threat to the public welfare in that the City currently has a concentration of RV Dealers who have made a large and long term investment to be located in the City of Colton and who may be adversely affected by the establishment of additional Recreational Vehicle dealers which may create an over supply of RV's to RVPUB\SRC\40441 -I-
