A. Prohibition Notwithstanding any other provisions of this Code and it <br />addition thereto, it shall be unlawful and is hereby declared a public nuisance for any person o <br />entity to willfully make, suffer, permit, continue, or cause to be made or continued, any loud <br />unnecessary, and unusual noise or any disturbance, commotion, gathering or event, whict <br />disturbs or tends to disturb the peace or quiet of any neighborhood or which causes or tends tc <br />cause discomfort or annoyance to any reasonable person of normal sensitivity within the area. <br />B. Standards The standards which may be considered in determining whether <br />violation of the provisions of this section exists may include, but not be limited to, the following: <br />Noise: <br />The level of the noise; <br />Whether the nature of the noise is usual or unusual; <br />Whether the origin of the noise is natural or unnatural; <br />The level and intensity of the background noise, if any; <br />The proximity of the noise to residential sleeping facilities; <br />The nature and zoning of the area within which the noise emanates; <br />The density of the inhabitation of the area within which the noise emanates; <br />The time of the day and night the noise occurs; <br />The duration of the noise; <br />Whether the noise is recurrent, intermittent, or constant; or <br />Whether the noise is produced by a commercial or noncommercial activity. <br />Public Safety: <br />The number of persons present in relation to the location used; <br />The effect on nearby pedestrian traffic; <br />The effect on nearby vehicular traffic or parking or both; <br />The extent of past threats to public safety at the particular location or at gatherings or <br />held or attended by the same individual or individuals or both; or <br />The presence of alcohol at the gathering or event. <br />C.
