I SECTION 4: Section 18.50.100 of the Colton Municipal Code is hereby amended to read <br />2 as follows: <br />3 <br />4 "18.50.100 Freeway -oriented signs. <br />5 <br />6 On -premises advertising in the form of a freestanding, freeway -oriented sign shall be permitted on <br />7 property containing a minimum street frontage of one -hundred (100) lineal feet, with the approval of <br />8 a conditional use permit, provided the following conditions are met: <br />9 <br />10 A. The property is located on a street which is adjacent to a freeway or whose only <br />11 separation from a freeway is a public or quasi -public right-of-way or easement. <br />12 B. The sign is a maximum of thirty-five (35) feet in height measured from the finish <br />13 grade of the freeway roadway. <br />14 C. The sign area does not exceed three hundred (300) square feet per sign face. <br />15 D. A freeway -oriented sign shall in no way endanger the health and safety by causing <br />16 distractions to operators of motor vehicles on the streets and/or highways. <br />17 E. A freeway -oriented sign shall be provided with adequate separation from other <br />18 freeway -oriented signs in the vicinity. <br />19 <br />20 In addition, freeway -oriented signs may advertise services or businesses located within three <br />21 hundred (300) feet of the property where the freeway -oriented sign is constructed, provided such <br />22 businesses or services are located on property that is held under the same ownership as the <br />23 property containing the freeway -oriented sign and the owner of the property records a legal <br />24 instrument, agreement or covenant agreeing to hold and sell the properties as a single development <br />25 or property. Such signs shall not be considered off-site advertising signs." <br />26 <br />27 SECTION 5: CEQA Determination. Based on the entire record before and all written and <br />28 oral evidence presented, the City Council finds the proposed Zone Text Application is categorically <br />exempt from the requirement of the California Environmental Quality Act (CEQA) pursuant to <br />18 -5- <br />
