1 ORDINANCE NO. 0-19-03 <br />2 <br />AN ORDINANCE OF THE CITY OF COLTON ADDING <br />3 SECTION 18.48.120 TO CHAPTER 18.48 OF THE COLTON <br />MUNICIPAL CODE TO REGULATE PARKNG OF VEHICLES <br />4 FOR SALE ON PROPERTY THAT IS NOT ZONED FOR <br />SUCH USE AND AMENDING SECTION 10.04.075 OF <br />5 CHAPTER 10.04 OF THE COLTON MUNICIPAL CODE <br />RELATING TO PARKING VEHICLES ON PUBLIC OR <br />6 PRIVATE PROPERTY WITHOUT PROPERTY OWNER'S <br />PERMISSION <br />8 <br />WHEREAS, within the City of Colton, public and private properties are being <br />9 used for the display of privately owned vehicles marked "for sale" and placed on said <br />10 properties for the primary purpose of sale, without the property owner's consent and where <br />11 no land use entitlement has been granted for the sale of used vehicles on said properties; <br />12 and <br />13 WHEREAS, allowing the use of property for the purpose of vehicle sales <br />14 without the granting of appropriate land use approval and environmental clearance creates <br />the potential for adverse land use and environmental impacts, which may include but are <br />15 <br />not limited to incompatibility of uses, increased runoff of motor vehicle fluids into surface <br />16 and groundwater, increased traffic congestion, deleterious effects on adjacent property <br />17 values and visual impacts to the streetscape along City streets; and <br />18 <br />19 WHEREAS, the City proposes adding Section 18.48.120 to Title 18 of the <br />20 Colton Municipal Code and the City Council has deemed it reasonable and beneficial at <br />this time to add Section 18.48.120 to regulate the use of land for non-permitted vehicle <br />21 <br />sales and parking of vehicles for the primary purpose of sale on properties adjacent to <br />22 roadways throughout the City; and <br />23 <br />24 WHEREAS, the adoption of Section 18.48.120 has been determined to be <br />25 consistent with the General Plan, specifically the following policies: <br />26 <br />(1) To create a land use pattern which provides a safe, harmonious and <br />27 attractive residential living environment; a balanced hierarchy of commercial <br />land uses which will service the consumer and economic needs of the City <br />28 and region. <br />(2) To provide a compatible mix and arrangement of land uses. <br />RVPUBIACD1654423 1 <br />
