SFITIQN 1.01 STATEIEVI OF PURFOSE A. There is presently, <br />within the City of Colton, an increasing number of apartment dmelli.ng units which if left uncontrolled will result <br />in inequitable rent increases and reduction in maintenance to maximize profits for owners. This results in blighted <br />areas which become a burden to other taxpayers of Colton. B. ybbile tore owners are in somewhat a different <br />position in that they have a substantial investment in a residence for which space is rented or leased. Alternative <br />sites for relocation of mobile homes are difficult to find due to the shortage of vacant spaces, the restrictions <br />of age, size or style of mobile hares permitted in many parks and related to the installation of mobile hones, <br />including permits, landscaping and site preparation. Additionally, the cost of moving a mobile home is substantial <br />and the risk of damage in moving is significant. The result of these conditions is the creation of a captive market <br />of mobile home owners and tenants. This immobility, in turn, contributes to the creation of a great imbalance in <br />the bargaining relationship between park owners and mobile tome park tenants in favor of the park owners. C. <br />Because rental dwelling units and while hones are often occupied by senior citizens, persons on fixed income and <br />persons of low or moderate income, exorbitant rent increases fall upon these individuals with particular harshness. <br />D. IJhile this ordinance is designed to protect renters frau unreasonable rent increases, it recognizes the reed of <br />rental owners to receive a just and reasonable return on their property and rental increases sufficient to cover <br />the increased cost of repairs, taxes, maintenance, insurance, upkeep and additional amenities. SEXTIOF 1.02 <br />DEELYIT 0% For the purpose of this ordianance the following words, terms and phrases shall have the following <br />meaning: A. Apartment -A ram or suite of connection room designed for independent housekeeping but with certain <br />mechanical conveniences such as heat, light or elevator service in canron with all persons occupying the building. <br />Sometimes called a flat. B. Apartment house -A building arranged in four (4) suites of connecting coons, each <br />suite designed for independent housekeeping but with certain services and/or conveniences in cannon with all <br />persons occupying the apartment house. Sometimes called an apartment building or flat house. Intended to include <br />apartment complexes as apartment building. C. Apartment Renter -Persons or persons who occupy an apartment or flat <br />in an apartment house, building or flat house and who pays a fee to the owner or owner's agent for that occupancy. <br />Saretimes called an apartment lessee or renter. D. Capital Improvements -Those improvements .which materially add <br />to the value of property, appreciably prolong its useful life, or adapt it to new uses, which are claimed by the <br />owner as capital expenses for Internal Revenue Code purposes and which are required to be amortized over the useful <br />life of the improvement pursuant thereto. E. Rent Review Camdssion -The rent review comnssion established by <br />Section of this ordinance. Also called Camassion. F. Consumer Price Index or C.P.I. The Index known as <br />"Consumer Price Index for all Urban Wage Consumers: for the Los Angeles -Long Beach -Anaheim Area," (Lase year, <br />1957), and if published for the San Bernardino-Riverside-0ntario Area for the year 1984, and thereafter. These <br />documents published by the United States Department of Labor, Bur.of Labor Statistics. G. Hearing Officer -A <br />person or persons designated by the Commission to conduct mediation and formal hearings, where necessary, pursuant <br />to the terms of this Chapter and any and all rules and regulations adopted pursuant thereto. The Commission shall <br />only designate as a hearing officer, a person or person v%tn have experience and/or training as professional <br />mediators, hearing officers, arbitrators, or judges. H. Housing Service Those services provided and associated <br />with the use or occupancy of an apartment unit or mobile tone park space, including but not limited to repairs, <br />insurance, maintenance, replacement, painting, light, heat, water, laundry facilities and privileges, refuse <br />removal, parking, recreation facilities, security service, and any other benefits, privileges or facilities <br />including in any rental agreement or lease. I. �bbile Ikme -A structure designed for human habitation and for <br />being moved on a street or highway under permit pursuant to Section 35790 of the Vehicle Code.:•bbile tome does not <br />include a recreational vehicle, as defined in Section 799.24 of the Civil Code or a commercial coach as defined in <br />Section 18128 of the Health and Safety code. J. ,bbile Hoe Owner or Resident -Any person entitiled to occupy a <br />mobile hone dw>?lling unit pursuant to rnmerhip thereof or a rental or lease agreement with the owner thereof. K. <br />�bbile Hare Park or Park -An area of land where two or more mobile here sites are rented, or held out for use, to <br />accoodate mobile tomes used for human habitation. L. �bbile Home Park Owner or Park Owns The owner, lessor, <br />operator, manager or designated agent thereof of a mobile ham park. Sometimes referred to as Omer. M. ?bbile <br />11me Space or Space The site within mobile tome park intended, designed, or used or the location or accommodation <br />of a moble hone and any accessory structures or appurtenances attached thereto or used in conjunction therewith. <br />N. Rental Agreeent -An agreement between a mobile here park owner or apartment owner and a tenant or renter <br />establishing the terms and conditions of a tenancy in a mobile hoe hark or apartment building. A lease is a rental <br />agreement. 0. Tenant -A mobile hone owner, apartment renter, resident or any other person who has a tenancy in an <br />apartment or mobile home park under a rental agreement. P. Space Rent, Apartment Rent or Rent The consideration, <br />including any bonus, benefits, or gratuities demanded or received for and in connection with the use or occupancy <br />of an apartment within an apartnent house or a mobile home space within a mobile here par's, or for housing services <br />provided, and security deposits, but exclusive of any amount paid for the use of the mobile hoe as a dwelling <br />unit. The use or occupancy of a rental unit shall include the exercise of all rights and privileges and use of <br />facilities, services and amenities accruing to the residents thereof. Q. Rent Increase -Any additional rent <br />demanded of or paid by a tenant, including any reduction in }musing services without a corresponding reduction in <br />the monies demanded or paid for rent. R. Tenancy -The right of a tenant to the use of an apartment within an <br />apartment building or mobile hoe site within a mobile hone park on which to locate, maintain and occupy a nubile <br />hone, site improvemnts and accessory structures; for human habitation, including the useof th services and <br />facilities of the apartment building or mobile home park. =ON 1.03 EXE`IPM%S FRQ°h =AGE 11-E PROVAGS OF <br />THIS CHAIM SHALL NOP .APPLY TO TIE FOLLOWDIG: A. New Space or First Time Space and New Apartnent or First Time <br />Apartment Rental Exemption -Space rent or space rent increases for new mobile hame spaces or apartment rent or <br />apartment rent increases for new apartments, where in newly constructed parks or apartment buildings or such units <br />first rented after the effective date of this Ordinance shall be exempt from the space rent ceiling provisions of <br />this Chnpter for the duration of such agreement. The exemption as provided for in this section stall terminate upon <br />the expiration apartment or space rental agreement unless such agreement is renewed or extended by mutual agreement <br />of the owner and residents. Any such renewiL or axtention of such agreement must meet the criteria set forth below. <br />n <br />
