Upon termination of the exemption, the apartment or mobile have park s;:wall be subject to the apartment or space <br />rent ceiling provisions of this chapter. 1. The agreement between the amer and the tenant thereof not establish <br />an apartment or space rent schedule for the building or park for a minaiman period of two (2) years from the date of <br />co mnence-ent of the agreement. 2. The agreement need not be a formal lease or follow anv prescribled format but the <br />rent must be binding upon both the owner and tenants for the duration thereof. The agreement may contain such other <br />provisions as nay be agreed upon by the parties thereof. 3. The agreement must be voluntarily consented to by at <br />lust one adult tenant fan sixty-seven percent (677) of the mobile lane rental spaces within the park or <br />apartments within the apartment building excluding those spaces or apartrrents exempted frau the provisions of this <br />chapter pursuant to the povisions of Section 1.03A. This consent shall be evidenced by the signature of such adult <br />tenants of such consent form as may be required by the commission. The consent form shall be circulated or provided <br />for signature only in accordance with such rules and regulations as may be established by the commission. <br />SIL'dTCN 1.04 MIT REVIBi 07fi1ISSICN; ESTABLISH= AND PC(gJM. A. Establishment The Rent Review Commission of the <br />City of Colton is hereby established. B. Composition -The Rent Review Cam.ission shall consist of seven (7) <br />regular nenbers and two (2) alternate members. One regular member shall be a mobile haneowner or tenant who resides <br />in the City of Colton; one regular member shall be an apartment renter who resides in the City of Colton; one <br />member shall be a mobile here park owner, operator, manager or designated agent of a mobile home park located in <br />the City of Colton; one member shall be an apartment building owner, operator, manager or designated agent of an <br />apartment building located in the City of Colton. The two alternate members shall be a mobile have owner, tenant or <br />apartment renter from different mobile ham park or apartment building than the regular member and an owner, <br />operator, manager, or designated agent from a different mobile tae park or apartment building than the regular <br />owner ambers. The remaining three (3) members shall be residents of the Citv of Colton who are not elected <br />officials, employees, relatives of elected officials or relatives of employees of the City of Colton, and who are <br />neither mobile hare owners or tenants, apartment renters, owners, operators , managers or designated agents of <br />mobile }ane parks or apartment buildings, and who have no conflicts of interest due to relationship with same. <br />Candidates for membership on the Camdssion shall submit a verified statement listing all interest in real property <br />or mobile taw described in Section 798.3 of the California Civil Code including ownership, individually, jointly, <br />legal or equitable, and all sales of such property, or instruments secured by such property within thirty (30) days <br />of seeking appointment to the Commission. C. Nonination and Appointment - The regular mobile here owner, the <br />regular apartment renter, the regular mobile tea park owner, the regular apartment building owner and the <br />respective alternate members stall be selected by the City Concil from a list of five (5) nom notions for the <br />Camdsson submitted by a general association on behalf of the various homeowners associations. The regular mobile <br />horse park owner and apartment building owner and the respective alternate members shall be selected by the City <br />Council from a list of five (5) noninaions supplied by a general association on behalf of the various mobile hare <br />park owners associations and apartment building owners associations. The City Council shall nominate and appoint <br />the three remaining regular Camussion members. All members of the Commission shall be selected in accordance with <br />applicable City procedures. The first Commission stall be constituted not moe than thirty (30) days frau enactment <br />hereof, and shall hold its first meeting in accordance with Section 1.04E. D. Term - Each regular member of the <br />Commission shall serve for a term of two years except as otherwise provided herein. For the first commission, the <br />two (2) renter menders, the two (2) owner members and the two (2) at-large resident members shall be appointed for <br />three (3) year terns. Thereafter, the successors stall be appointed for terms of two (2) years. Each regular member <br />shall hold office until a new menbre has been duly appointed. Each alternate member of the Commission shall serve <br />for a term of two (2) years except as provided herein. Fach alternate member shall hold office until a new <br />alternate member has been duly appointed. If a vacancy occurs other than expiration of the tern, it shall be filled <br />by appointment as previously prescribed herein for the unexpired portion of such menber's term. The provisions <br />hereinabove notwithstanding, a mennber may be removed, at any time, with cause, by a majority vote of the City <br />Council. Any amender who is absent, without sufficent cause, from three (3) consecutive meetings of the Camdssion <br />'.which such member was required to attend shall be deemed to have vacated his office. E. MeetiMs - To fulfill its <br />fanctions, the Commission shall meet as often as it deems necessary, but at least one regularly scheduled public <br />meeting shall be held every ninety (90) days, or within thirty (30) days of any hearing or arbitraton held <br />hereunder, whichever is earlier. All members of the Camdssioh, regulars and alternates, stall be required o attend <br />all Can mission meetings and hearings unless such member has been disqualified from participation. Except as <br />expressly provided herein, the Camdssion shall establish the time and place of its meetings. All meeting of the <br />Camdssion shall be conducted in accordance with the provisions of the Palph A. Brown Act. F. Voting - The <br />affirmative vote of four (4) Camdssicners of the Comissioh is required for a decision, including all m. tions, <br />regulations and orders of the Camdssioh. ldhen a r gular renter, tenant or owner member is absent fran a meeting, <br />his or her alternate member shall participate in the Commission proceedings in place of the absent regular member. <br />An alternate member stall have voting privileges only when acting in the stead of an absent regular member. G. <br />Quorum - Five (5) Cc m issioners shall constitute a quorum. A majority vote of all the Camdssoners, i.e., five (5) <br />votes,is required for adoption of any findings and/or pertaining to an application filed hereunder and for the <br />adoption, amendment or repeal of any rules and regulations of the Comdssion. A majority vote of the quorum of the <br />Comnission is required for the (omission to take action on anv other matters. H. Cmmissoh Powers1d Duties - <br />The Camdssion shall undertake and have the following duties, responsibilities, and functions together h,rith all <br />owers reasonably incidental thereto:l. Adoption of Rules and Regulat=ons, lie Cam fission may Hake and adopt its <br />own administrative rules and regulations as may be necessary to effectuate the purposes and policies of this <br />Chapter and to enable the Cmunissah to carry out its powers and duties thereunder, so long as such rules and <br />regulations are consistent with the laws of the State, this Chapter, and any guidelines adopted by the City <br />Council. Any such rules and regulations shall be reduced to writing and be on file frith the Secretary of the <br />Commission at all tines. 2. Appointment of officers. Thhe Commission may appoint such officers as it may deem <br />necessary to carry out its duties hereunder. 3. I,aintenance of Records. The Camdssion shall keep a record of its <br />Proceedings, which shall be open for inspection by any member of the public. 4. Appointment of Committees, <br />`bdiators, and Ihearir; Officers. The Cmrdssion any appoint comittees, mediators and hearing officers to hear <br />matters on which testimony must be taken, which cmnlittees, mediators and hearing officers shall report to the <br />cmrdssion the findings and results of any such hearing on a matter referred to such c,='ttee or person upon <br />request. "ediators or hearing officers appointed by the Commission shall meet the definition of hearing officer <br />contained in Subsection 1.02F above. 5.:lolding meetings.
