R-116-87 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />GRANTING TO SOUTHERN PACIFIC PIPE LINES, INC. A FRANCHISE <br />TO CONSTRUCT, MAINTAIN AND OPERATE PIPELINES WITHIN THE <br />PUBLIC ROADS, STREETS AND WAYS OF THE CITY OF COLTON <br />BE IT RESOLVED BY THE CITY COUNCIL AS FOLLOWS: <br />SECTION 1. The right, privilege and franchise are <br />hereby granted by the City of Colton, hereinafter referred to as <br />"City", to Southern Pacific Pipe Lines Inc., hereinafter referred <br />to as "Grantee", for a period of forty years from and after the <br />granting of this franchise to construct, maintain, inspect, <br />operate, protect, repair, replace and retain in place a pipeline <br />or pipelines, control facilities and other appurtenances, <br />including any facilities necessary for cathodic protection <br />thereof, initially or hereafter installed, for the transportation <br />of refined petroleum products and other liquid substances in, <br />under, along and across public streets, roads, highways, alleys <br />and other public ways (hereafter collectively referred to as <br />"public ways") of the City of Colton. This franchise shall <br />be effective for the pipeline route(s) first approved hereunder, <br />and for any additions thereto which may hereafter be approved <br />by the "City" official designated therefore by the City Council. <br />SECTION 2. This franchise and privilege are granted <br />and shall be held and enjoyed only upon the provisions and <br />conditions prescribed by law and those contained in this resolution <br />and shall not be effective until "Grantee" has filed with the <br />City Clerk a written acceptance of the terms and conditions of <br />
