SECTION 3• The "Grantee" shall, during the life of this franchise, pay to the "City", an annual franchise fee computed on the basis of two percent of the gross annual receipts of the "Grantee" arising from the use, operation or possession of this franchise; provided, however, that such payment shall in no event be less than such other amount approved by the City Council as may be provided for public utility pipelines for oil or products thereof by applicable law of the State of California as the same ma; be amended. Said payment shall be made annually to the "City" by "Grantee". Computations for the franchise fee shall be made in the same manner as computations under Sections 6001et. seq. of the California Public Utilities Code, commonly known as the Broughton Act, and in particular Section 6006 thereof, or Section 6201 et. seq. of said Code commonly known as the Franchise Act of 1937, and in particular, Section 6231 thereof, as said Code may be from time to time amended. The "Grantee" shall file with the City Clerk within three months after the expiration of the calendar year for which payment is due, a verified statement specifying in detail the total gross receipts of said "Grantee" during the preceding calendar year (or fractional calendar year) of the term hereof, arising from the use, operation or possession of this franchise within the City of Colton and shall pay to the City Finance Department the franchise fee coincident with the filing of such statement. Any neglect, omission or refusal of the "Grantee" to file such verified statement, or to pay such annual franchise fee, at the time or in the manner here-
