R-52 -87 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON DECLARING ITS INTENTION <br />TO FORM AN IMPROVEMENT DISTRICT AND <br />FIXING THE TIME AND PLACE OF HEARING <br />ON SUCH FORMATION (IMPROVEMENT DISTRICT <br />"A" OF THE CITY OF COLTON) <br />WHEREAS, pursuant to an executed agreement with the James <br />Sullivan Mutual Water Company, the City of Colton has proposed to <br />acquire the entire water distribution system of the Company, here- <br />inafter referred to as the "Sullivan Water System", and to provide <br />retail water service to the customers located within the area <br />presently served by the James Sullivan Mutual Water Company, here- <br />inafter referred to as the "Sullivan Service Area"; and <br />WHEREAS, the City's agreement to accept ownership and <br />operation of the Sullivan Water System was prompted by requests by <br />customers and property owners within the Sullivan Service Area, <br />following a public meeting with such customers and property owners <br />during which they agreed to bear the costs of necessary improvemen <br />to upgrade the antiquated Sullivan Water System; and <br />WHEREAS, the James Sullivan Mutual Water Company contem- <br />plates financing the necessary improvements to the Sullivan Water <br />System with a loan from the State of California pursuant to the <br />Safe Drinking Water Bond Law in the amount of Three Hundred Eighty <br />Nine Thousand One Hundred Eighty -Five Dollars and Twenty -Five Cent <br />($389,185.25) and repaying the loan of such amount with revenue <br />derived from a special tax to be imposed on all real property <br />within the Sullivan Service Area; and <br />WHEREAS, the City is authorized and empowered to form an <br />
