1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 II <br />5 <br />(ii) pursuant to said Section 53326, Resolution No. R-155-87 and <br />Resolution No. R-156-87, the City Clerk distributed ballots for <br />the consolidated special elections to such landowners by mail <br />with return postage prepaid; (iii) all owners of land within the <br />Community Facilities District waived the time limits for holding <br />the consolidated special elections and the election dates <br />specified in said Section 53326, and consented to the calling <br />and holding of said consolidated special elections on January 5, <br />1988; (iv) said consolidated special elections have been <br />properly conducted in accordance with all statutory requirements <br />and the provisions of Resolution No. R-155-87 and Resolution <br />I <br />No. R-156-87; (v) pursuant to said Section 53326, the owners of <br />land within the Community Facilities District, who owned a <br />combined acreage of approximately 55 acres were entitled to a <br />total of 55 votes; (vi) ballots were returned to the City Clerk <br />prior to 5:00 p.m. on January 5, 1988, by all persons having <br />ownership interests in land within the Community Facilities <br />District; (vii) the ballots returned to the City Clerk by all <br />owners of or persons having ownership interests in land within <br />the Community Facilities District voted all votes of said <br />landowners in favor of all propositions set forth therein; <br />(viii) more than two-thirds of the votes cast in such <br />consolidated special elections on each such proposition were in <br />favor thereof, and pursuant to Sections 53328, 53329 and 53355 <br />of the California Government Code, all such propositions <br />carried; (ix) the City Council, as the legislative body of the <br />Community Facilities District, is therefore authorized to take <br />the necessary action to have the Community Facilities District <br />-3- <br />
