1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />special taxes on the property in the Community Facilities <br />District to pay the principal of and interest on the bonds <br />thereof and to finance the provision of police protection <br />and fire protection and suppression services therein, and <br />the establishment of an appropriations limit in the amount <br />of $1,000,000 for the Community Facilities District, and all <br />votes cast in said consolidated elections were in favor of <br />all such propositions; and <br />WHEREAS, pursuant to Section 53359 of the Cali- <br />fornia Government Code, the City Council may order the com- <br />mencement of an action to determine the validity of the <br />bonds of the Community Facilities District and the validity <br />of the special taxes to be levied to pay the principal of <br />and interest on such bonds and to finance the provision of <br />police protection and fire protection and suppression <br />services therein, pursuant to Chapter 9 (commencing with <br />Section 860) of Title 10 of Part 2 of the California Code of <br />Civil Procedure; <br />NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND <br />ORDERED BY THE CITY COUNCIL OF THE CITY OF COLTON that Best, <br />Best & Krieger, bond counsel to the City in connection with <br />the proceedings for the establishment of the Community <br />Facilities District and the issuance of the bonds thereof, <br />is authorized to commence an action pursuant to Chapter 9 <br />(commencing with Section 860) of Title 10 of Part 2 of the <br />California Code of Civil Procedure to determine the validity <br />of the bonds of the Community Facilities District and the <br />validity of the special taxes to be levied on taxable prop- <br />-2- <br />
