ATTACHMENT #2 AGENCY: CITY OF COLTON PROJECT: ANNEXATION NO. 1, COMMUNITY FACILITIES DISTRICT NO. 88-1 COMMUNITY FACILITIES DISTRICT "REPORT" "MELLO-RODS COMMUNITY FACILITIES ACT OF 198211 WHEREAS, the CITY COUNCIL of the CITY OF COLTON, CALIFORNIA (hereinafter referred to as the "legislative body of the local Agency), is desirous to annex territory to an existing Community Facilities District pursuant to the terms and provisions of the "Mello -Roos Community Facilities Act of 1982," being Chapter 2.5, Part 1, Division 2, Title 5, of the Government Code of the State of California, and specifically Article 3.5 thereof. The existing Community Facilities District has been designated as COMMUNITY FACILITIES DISTRICT NO. 88-1 (hereinafter referred to as the "District"); and, WHEREAS, the area proposed to be annexed shall be known and designated as ANNEXATION NO. 1, COMMUNITY FACILITIES DISTRICT NO. 88-1 (hereinafter referred to as the "annexation territory"). WHEREAS, this legislative body hereby directs the preparation of an Annexation "Report" to provide more detailed information relating to the existing District, the area proposed for annexation, the existing and proposed public facilities, and the special tax rate and method of apportionment to be authorized for levy within said annexed territory. WHEREAS, Resolution No. R-6-89 of the legislative body directed the Report contain the following: A. A general description of territory included in the existing District; B. A general description of the annexation territory; C. A description of the public capital facilities provided in the existing District; D. A description of the public capital facilities to be provided in the annexation territory, including a plan for sharing facilities that will be provided in common with the existing District and the annexation territory; E. General description of special taxes to be levied within the annexation territory to pay for said public facilities. A special tax to pay for public facilities financed through bonds may be adjusted as authorized by Section 53339.2.
