within the Community Facilities District; (ii) pursuant to said <br />1 Section 53326, Resolution No. R-120-90 and Resolution No. R-121- <br />2 90, the City Clerk distributed ballots for the consolidated <br />3 special elections to such landowners by mail with return postage <br />4 prepaid or by personal delivery; (iii) all owners of land within <br />5 the Community Facilities District waived the time limits for <br />6 holding the consolidated special elections and the election dates <br />7 specified in said Section 53326, and consented to the calling and <br />8 holding of said consolidated special elections on November 6, <br />9 1990; (iv) said consolidated special elections have been properly <br />10 conducted in accordance with all statutory requirements and the <br />it provisions of Resolution No. R-120-90 and Resolution No. R-121-90; <br />12 (v) pursuant to said Section 53326, the owners of land within the <br />13 Community Facilities District, who owned a combined acreage of <br />14 approximately 15.15 acres (2.34 Lebanoff -McKnight and 12.81 <br />15 Mt. Vernon Shopping Center Associates, Ltd.) were each entitled to <br />16 a total of 3 votes (Lebanoff-McKnight) and 13 votes (Mt. Vernon <br />17 Shopping Center Associates, Ltd.), respectively; (vi) ballots were <br />18 returned to the City Clerk prior to 5:00 p.m. on November 6, 1990, <br />19 by all owners of land within the Community Facilities District; <br />20 (vii) the ballots returned to the City Clerk by all owners of land <br />21 within the Community Facilities District voted all votes of said <br />22 landowners in favor of all propositions set forth therein; <br />23 (viii) more than two-thirds of the votes cast in such consolidated <br />24 special elections on each such proposition were cast in favor <br />25 thereof, and pursuant to Sections 53328, 53329 and 53355 of the <br />26 California Government Code, all such propositions carried; (xi) <br />27 the City Council, as the legislative body of the Community <br />28 <br />-3- <br />
