The abandonment and vacation of <br />Centerpointe Dr. shall not be effective unless and until <br />Gatlin/Berger acquires fee title to the Acquisition Property <br />and the City shall not record any documentation evidencing <br />the abandonment until Gatlin/Berger has acquired fee title <br />to the Acquisition Property. <br />SECTION 3. Accordingly, the City Council of the <br />City of Colton hereby orders the vacation of Centerpointe <br />Dr. upon Gatlin/Berger's acquisition of fee title to the <br />Acquisition Property, pursuant to the foregoing terms and <br />conditions. <br />PASSED, APPROVED and ADOPTED this 3rd day of <br />July, 1990. <br />cAPPROVED AS TO FORM: <br />J <br />STEPHEN W.
