R-88-91 <br />2 RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON ADOPTING AN OFFICIAL <br />3 POSITION WITH REGARD TO THE PROPOSED <br />FEDERAL LEGISLATION JOHNSTON/BREAUX <br />4 BASE CLOSURE AMENDMENT <br />5 <br />6 <br />7' <br />8 <br />9' <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21' <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the City of Colton is a member of the Inland <br />Valley Development Agency (IVDA) which is a joint powers authority <br />duly organized and existing pursuant to the laws of the State of <br />California for the purpose of causing the reuse of Norton Air <br />Force Base (NAFB) and the redevelopment of NAFB and other prop- <br />erties in proximity thereto; and, <br />WHEREAS, the City of Colton, as an IVDA member, is con- <br />cerned as to the impacts of existing and proposed federal legis- <br />lation that would adversely affect the financial ability of the <br />IVDA to acquire NAFB and to reuse and redevelop NAFB; and, <br />WHEREAS, the City of Colton is aware of proposed <br />federal legislation known as the Johnston/Breaux Base Closure <br />Amendment to S.1507 as is presently being considered by the <br />Congress of the United States; and, <br />WHEREAS, the City of Colton has been advised that said <br />Johnston/Breaux Base Closure Amendment, if adopted in its present <br />form, may have further adverse impacts upon the ability of the <br />IVDA to redevelop NAFB and properties in proximity thereto. <br />NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council <br />of the City of Colton as follows: <br />Section 1. The City of Colton supports any federal <br />legislation that would enable the Department of Defense (DOD) to <br />parcelize uncontaminated portions of NAFB upon base closure to <br />enable the timely transfer of such properties to the IVDA and at <br />the same time allowing the DOD to retain the remaining contaminate, <br />portions of NAFB pending ultimate remediation at the sole cost of <br />the DOD. Any such federal legislation must also allow contaminate, <br />groundwater clean-up to occur subsequent to the transfer of the <br />NAFB properties to the IVDA without negatively impacting such <br />transfer of surface land rights. <br />Section 2. The City of Colton further supports any <br />federal legislation that would allow all of the NAFB properties to <br />
