RESOLUTION NO. R-11-92 <br />RESOLUTION OF CONSIDERATION OF THE <br />CITY COUNCIL OF THE CITY OF COLTON <br />AMENDING THE RESOLUTION OF INTENTION <br />WITH RESPECT TO COMMUNITY FACILITIES <br />DISTRICT NO. 88-1 OF THE CITY OF <br />COLTON BY CHANGING THE TYPES OF <br />PUBLIC FACILITIES AUTHORIZED TO BE <br />FINANCED BY SAID COMMUNITY FACILI- <br />TIES DISTRICT <br />WHEREAS, the City Council (the "City Council") of the <br />City of Colton (the "City") has previously conducted proceedings, <br />pursuant to Chapter 2.5 (commencing with Section 53311) of Part 1 <br />of Division 2 of Title 5 of the California Government Code, <br />commonly known as the Mello -Roos Community Facilities Act of 1982, <br />as amended (the "Act") to form and establish Community Facilities <br />District No. 88-1 of the City of Colton (the "District"), and has <br />formed and established the District; and <br />WHEREAS, in connection with those formation proceedings <br />the City Council previously adopted Resolution No. R-68-88 on <br />August 2, 1988 (the "Resolution of Intention") with respect to the <br />City's intention of establishing the District, and the City Council <br />adopted Resolution No. R-82-88 on September 6, 1988 (the <br />"Resolution of Formation") establishing the District; and <br />WHEREAS, the Resolution of Intention contained a descrip- <br />tion of the types of public facilities to be financed by the Dis- <br />trict; and <br />WHEREAS, the City Council wishes to amend the Resolution <br />of Intention and the Resolution of Formation by amending the types <br />of public facilities authorized to be financed by the District; and <br />WHEREAS, Section 53331 of the Act authorizes the City <br />Council to adopt a resolution of consideration, upon a finding that <br />the public convenience and necessity require changes in the types <br />of authorized public facilities to be financed by the District; and <br />WHEREAS, the City Council must fix a time and a place for <br />hearing upon this Resolution of Consideration, which hearing shall <br />not be less than 30 nor more than 60 days after adoption of the <br />resolution of consideration; and <br />WHEREAS, the City Clerk of the City Council must give <br />notice of the hearing in accordance with Section 53322 of the Act; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS <br />FOLLOWS: <br />KRW87313 <br />
